The Mexican chemical industry operates within a dynamic regulatory landscape, currently characterized by a multiplicity of governing bodies and a lack of a single, overarching chemical control law. However, several potential regulatory changes are on the horizon, driven by a push for greater environmental and health protection, international harmonization, and a need to address existing complexities.

One of the most significant potential changes is the formal adoption and implementation of the proposed General Law for the Integral Management of Chemical Substances (LGGISQ). This draft legislation, first proposed in 2019, aims to establish a comprehensive legal framework for chemical management in Mexico. Key features expected in the LGGISQ include the creation of a National Registry of Chemical Substances (ReNaSQ), requiring industries to provide information on the risks associated with their substances, and potentially introducing stricter requirements for risk assessment, restrictions, and bans on certain chemicals. While its approval has been delayed, its potential implementation represents a fundamental shift towards a more centralized and stringent regulatory system akin to those in other major economies.

Beyond the potential broad strokes of the LGGISQ, specific regulatory bodies are likely to continue refining and updating their existing mandates. The Ministry of Environment and Natural Resources (SEMARNAT) is expected to further develop regulations related to environmental protection, hazardous waste management, and emissions. This could involve updates to existing Official Mexican Standards (NOMs) concerning permissible emission limits, waste classification, and treatment and disposal requirements. SEMARNAT, in coordination with other agencies, is also involved in regulating the import and export of certain toxic substances, an area that saw revised verification requirements by PROFEPA (Federal Attorney for Environmental Protection) in April 2024.

The Federal Commission for the Protection against Sanitary Risks (COFEPRIS), responsible for regulating chemicals that impact public health, is likely to continue its oversight of substances used in food, pharmaceuticals, cosmetics, and other consumer products. Potential changes here could involve updated requirements for product registration, labeling, and the evaluation of health risks. COFEPRIS already requires a "Notice of Operation" for chemical companies, and this process could see further refinement.

The Ministry of Communications and Transportation (SCT) is the key authority for regulating the transportation of hazardous chemical products. While existing NOMs govern aspects like packaging, labeling, and transport conditions, ongoing efforts to harmonize with international standards (like the UN Model Regulations) could lead to updates and changes in transportation requirements. Given the challenges in logistics and infrastructure within Mexico, there might also be regulatory pushes to improve safety and tracking in chemical transportation.

Furthermore, international trade agreements, particularly the USMCA, and global trends towards greater sustainability and chemical transparency can influence regulatory changes in Mexico. There could be pressure to align Mexican regulations more closely with those in the United States and Canada to facilitate trade, particularly in areas like chemical classification and labeling (e.g., further alignment with GHS).
